A fundamental tax planning strategy is to accelerate deductible expenses into the current year. This typically will defer (and in some cases permanently reduce) your taxes. But there are exceptions. One is if the additional deductions this year trigger the alternative minimum tax (AMT). Complicating matters for 2017 is the fact that tax legislation might be signed into law between now and year end that could affect year-end tax planning. For example, as released by the Ways and Means Committee of the U.S. House of Representatives on November 2, the Tax Cuts and Jobs Act would repeal the AMT for 2018 and beyond. But the bill would also limit the benefit of some deductions and eliminate others. The AMT and deductions Some deductions that currently are allowed for regular tax purposes can trigger the AMT because they arenâ??t allowed for AMT purposes: â?¢ State and local income tax deductions, â?¢ Property tax deductions, and â?¢ Miscellaneous itemized deductions subject to the 2% of adjusted gross income floor, such as investment expenses, tax return preparation expenses and unreimbursed employee business expenses. Under traditional AMT strategies, if you expected to be subject to the AMT this year but not next year, to the extent possible, youâ??d try to defer these expenses until next year. If you ended up not being subject to the AMT this year, in the long-term you generally wouldnâ??t be any worse off because you could enjoy the tax benefits of these deferred expenses next year. But under the November 2 version of the House bill, the state and local income tax deduction and certain miscellaneous itemized deductions would be eliminated beginning in 2018. And the property tax deduction would be limited. So if you were to defer such expenses to next year, you might permanently lose some or all of their tax benefit. Income-related AMT triggers Deductions arenâ??t the only things that can trigger the AMT. So can certain income-related items, such as: â?¢ Incentive stock option exercises, â?¢ Tax-exempt interest on certain private activity bonds, and â?¢ Accelerated depreciation adjustments and related gain or loss differences when assets are sold. If you could be subject to the AMT this year, you may want to avoid exercising stock options. And before executing any asset sales that could involve depreciation adjustments, carefully consider the AMT implications. Uncertainty complicates planning Itâ??s still uncertain whether the AMT will be repealed and whether various deductions will be eliminated or limited. The House bill will be revised as lawmakers negotiate on tax reform, and the Senate is releasing its own tax reform bill. Itâ??s also possible Congress wonâ??t be able to pass tax legislation this year. With proper planning, you may be able to avoid the AMT, reduce its impact or even take advantage of its lower maximum rate (28% vs. 39.6%). But AMT planning is more complicated this year because of tax law uncertainty. We can help you determine the best strategies for your situation. The good news is that not only does an HSA provide a tax-advantaged way to pay for health care costs, but it also can help you achieve your estate planning goals. How does it work? An HSA can be offered by an employer, or an individual can set up his or her own account, similar to an IRA. Contributions to an employer-sponsored HSA are pretax and may be made by employers, employees or both. If you set up your own HSA, you can deduct your contributions. An HSA must, however, be coupled with a high-deductible health plan (HDHP). For 2017, to qualify as an HDHP, a plan must have a minimum deductible of $1,300 ($2,600 for family coverage) and a $6,550 cap on out-of-pocket expenses ($13,100 for family coverage). Even if you have HDHP coverage, you generally wonÃ?¢??t be eligible to contribute to an HSA if youÃ?¢??re also covered by any non-HDHP health insurance (such as a spouseÃ?¢??s plan) or if youÃ?¢??re enrolled in Medicare. For 2017, the maximum HSA contribution is $3,400 ($6,750 for family coverage). If youÃ?¢??re age 55 or older, you can make additional Ã?¢??catch-upÃ?¢?Ã? contributions of up to $1,000. The HSA funds can bear interest or be invested on a tax-deferred basis. You can make tax-free withdrawals to pay for qualified medical expenses. Unused funds may be carried over from year to year, continuing to grow tax-deferred. Withdrawals before age 65 not used for medical expenses will be subject to income tax and a 20% penalty. But after age 65, the penalty wonÃ?¢??t apply. Essentially, to the extent you donÃ?¢??t need the funds for medical expenses before age 65, an HSA serves as a supplemental IRA. What are the estate planning benefits? Like an IRA or a 401(k) plan account, HSAs with unused balances can supplement your retirement income or continue growing on a tax-deferred basis for the future benefit of your family. Unlike most other retirement savings vehicles, however, there are no required minimum distributions from HSAs, potentially allowing you to leverage tax-deferred compounding to build up a larger account for your heirs. Carefully consider your HSAÃ?¢??s beneficiary designation. When you die, any remaining HSA balance becomes the beneficiaryÃ?¢??s property. If the beneficiary is your spouse, your HSA becomes his or her HSA and is taxable only to the extent he or she makes nonqualified withdrawals. If the beneficiary is someone other than your spouse, however, the account no longer will qualify as an HSA.
